License agreement
This agreement governs your use of the TABL Mobile iPhone and iPad app, as distributed through Apple's App Store.

This End User License Agreement ("Agreement") is between you and TABL Service LLC ("TABL," "we," "us," or "our"), not Apple. TABL Mobile is licensed, not sold, to you for use on Apple-branded products you own or control, subject to this Agreement and the Usage Rules in the Apple Media Services Terms and Conditions.
You may not copy, rent, lease, sell, sublicense, redistribute, reverse engineer, decompile, disassemble, modify, or attempt to derive source code from TABL Mobile except to the extent allowed by applicable law.
TABL Mobile is intended for business operators and authorized staff using TABL services. You represent that you are authorized to use the app for the relevant business account and that your use will comply with applicable laws, payment rules, tax obligations, and business licensing requirements.
TABL Mobile has no monthly software fee. Card-present payment processing uses Stripe, and Stripe's terms, verification requirements, fees, settlement timing, refund rules, dispute rules, and privacy practices apply to your use of Stripe.
For card-present transactions, the business-paid processing estimate is 2.7% + $0.05 through Stripe. A customer-paid service fee is based on order size, with a $0.35 minimum and $1.00 maximum. You remain responsible for taxes, refunds, chargebacks, disputes, and any fees or obligations that apply to your business transactions.
TABL Mobile may connect to TABL Portal, TABL Digital Menu, KDS workflows, Stripe, payment hardware, cloud services, communication tools, links, or other external services. Use of external services may be subject to additional terms. TABL is not responsible for third-party content, service availability, or third-party data practices.
TABL may collect and use technical, business, account, app activity, and support information to provide and improve TABL Mobile, support users, maintain security, and comply with law. Our privacy practices for TABL Mobile are described in the TABL Mobile Privacy Policy.
TABL may release updates, patches, fixes, and feature changes. Unless a separate license accompanies an update, this Agreement applies to updates. Apple has no obligation to provide maintenance or support for TABL Mobile.
This Agreement remains effective until terminated by you or TABL. Your rights terminate automatically if you violate this Agreement. Upon termination, you must stop using TABL Mobile and delete it from your devices.
TABL Mobile is provided "as is" and "as available." To the maximum extent permitted by law, TABL disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. TABL is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or payment-processing losses.
You agree to defend, indemnify, and hold harmless TABL, its officers, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising from your use of TABL Mobile, your business transactions, your violation of this Agreement, or your violation of applicable law.
Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Once you accept this Agreement, Apple has the right to enforce it against you as a third-party beneficiary. TABL, not Apple, is responsible for TABL Mobile, its content, support, warranty claims, product claims, and intellectual-property claims to the extent required by applicable law.
This Agreement is governed by the laws of the State of New York, without regard to conflict-of-law principles. Any action or proceeding must be brought in state or federal courts located in New York County, New York, unless applicable law requires a different venue.
